Privacy Policy

The purpose of this Privacy Policy is to determine the terms and conditions accepted for the confidentiality and security of the data shared with the Company by the Site users/members/visitors (Hereinafter referred to as the “USER” or “DATA OWNER”) or generated by the Company during the use of the DOMAIN by the DATA OWNER during the services provided through the website (Hereinafter referred to as the “DOMAIN”) operated by Borusan Birleşik Boru Fabrikaları Sanayi ve Ticaret AŞ. (Hereinafter referred to as the “COMPANY”) and/or its service providers.

HWhat Data Is Processed?

Under this heading, the personal data processed by the Company in accordance with the Personal Data Protection Law No. 6698 are specified below, including but not limited to those listed. Unless otherwise explicitly stated, the term “personal data” shall include the following information within the scope of the terms and conditions set forth in this Privacy Policy:

  • Identity Information (Name - Surname)
  • Contact Information (Phone, address, e-mail)
  • Transaction Security (IP address, user transaction records)

The Company can obtain information about the DATA OWNER's use of the DOMAIN by using cookies, which are technical communication files, and IP information is collected through cookies to identify access to the services offered on the Site and usage habits and to make improvements on the Site.

Data that is rendered irreversibly anonymous in accordance with Articles 3 and 7 of the Personal Data Protection Law will not be considered as personal data in accordance with the provisions of the said Law, and processing activities related to this data will be carried out without being bound by the provisions of this Privacy Policy.

For What Purposes Are Data Used?

The COMPANY processes the personal data provided by the DATA OWNER to use the services offered on the DOMAIN and to ensure the legal, technical and commercial security of our Company and the persons who have a business relationship with our Company, and in this context, to provide the necessary information to the DATA OWNER and to fulfill the obligations arising from the nature of these activities.

The Company may also process the aforementioned personal data to improve the services it offers, to develop the service and to provide the necessary information to the DATA OWNER within this scope and to fulfill the obligations arising from the nature of the services it offers.

Söz konusu kişisel bilgiler VERİ SAHİBİ ile temas kurmak veya VERİ SAHİBİ’nin DOMAİN’deki tecrübesini iyileştirmek (mevcut hizmetlerin geliştirilmesi, yeni hizmetler oluşturulması ve kişiye özel hizmetler sunulması gibi) amacıyla kullanılabileceği gibi, ŞİRKET raporlama ve iş geliştirme faaliyetleri kapsamında kullanılabilecek, VERİ SAHİBİ’nin kimliği ifşa edilmeden çeşitli istatistiksel değerlendirmeler yapma, veri tabanı oluşturma ve pazar araştırmalarında bulunma amacıyla da kullanılabilecektir. Söz konusu bilgiler VERİ SAHİBİ’nin gerekli izinleri vermesi halinde ŞİRKET ve işbirliğinde olduğu kişiler tarafından doğrudan pazarlama yapmak amacıyla işlenebilecek, saklanabilecek, üçüncü kişilere iletilebilecek ve söz konusu bilgiler üzerinden çeşitli uygulama, ürün ve hizmetlerin tanıtımı, bakım ve destek faaliyetlerine ilişkin bildirimlerde bulunma amacıyla VERİ SAHİBİ ile iletişime geçilebilecektir.

Şirket ayrıca, Kişisel Verilerin korunması Kanunu’nun 5 ve 8. maddeleri uyarınca ve/veya ilgili mevzuattaki istisnaların varlığı halinde kişisel verileri Veri Sahibi’nin ayrıca rızasını almaksızın işleyebilecek ve üçüncü kişilerle paylaşabilecektir. Bu durumların başlıcaları aşağıda belirtilmiştir:

  • Data processing is mandatory for the legitimate interests of the Company, provided that it does not harm the fundamental rights and freedoms of the Data Owner.

Who Can Access the Data?

The Company may transfer the Data Owner's personal data and the new data obtained using this personal data to third parties from whom the Company benefits in order to achieve the purposes specified by the Data Owner in this Privacy Policy, limited to the provision of such services.

The Company may share the Data with third parties such as company outsourcing service providers, hosting service providers (hosting services), law firms, research companies, business partners, suppliers, company shareholders, call centers, including those sending SMS, in order to improve the Data Owner experience (including improvement and personalization), ensure the security of the Data Owner, detect fraudulent or unauthorized use, conduct operational evaluation research, fix errors related to the Site or Company services, and to achieve any of the purposes set forth in this Privacy Policy. It may be shared with these organizations upon the requests of authorized institutions and organizations.

With this Privacy Policy, the Company informs the Data Owner that the aforementioned third parties may store the Data Owner's personal data on their servers anywhere in the world, limited to the purposes specified above.

Kişisel Verilerinize İlişkin Haklarınız

Veri Sahibi, Şirket’e başvurarak kendisi ile ilgili;

  • Learning whether personal data is being processed,
  • Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,
  • Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
  • Yurt içinde veya yurt dışında kişisel verilerin aktarıldığı üçüncü kişileri bilme,
  • Kişisel verilerin eksik veya yanlış işlenmiş olması halinde bunların düzeltilmesini isteme,
  • İlgili mevzuatta öngörülen şartlar çerçevesinde kişisel verilerin silinmesini veya yok edilmesini isteme,
  • İlgili mevzuat uyarınca yapılan düzeltme, silme ve yok edilme işlemlerinin, kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
  • To object to a result that is to the detriment of the person himself/herself, as a result of the analysis of the processed data exclusively through automatic systems,
  • Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması halinde zararın giderilmesini talep etme, haklarına sahiptir.

The Data Owner is responsible to the Company for ensuring that the information subject to this Privacy Policy provided to the Company through the Site and by using the Site is complete, accurate and up-to-date; and must immediately update any changes to this information. The Company will not have any liability if the Data Owner fails to provide up-to-date information.

If the Data Owner makes a request that will result in the Company not being able to use any of his/her personal data, he/she may not be able to fully benefit from the services that the Company has committed to him/her. He/she declares that he/she will be responsible for any and all responsibilities arising from this.

Kişisel Verilerin Saklama Süresi

The COMPANY will store the personal data provided by the DATA OWNER for the period required for the processing purposes specified above.

Buna ek olarak, ŞİRKET, VERİ SAHİBİ ile arasında doğabilecek herhangi bir uyuşmazlık durumunda, uyuşmazlık kapsamında gerekli savunmaların gerçekleştirilebilmesi amacıyla sınırlı olmak üzere ve ilgili mevzuat uyarınca belirlenen zamanaşımı süreleri boyunca kişisel verileri saklayabilecektir.

Data Security Precautions and Commitments

Şirket, ilgili mevzuatta belirlenen veya işbu Gizlilik Politikası’nda ifade edilen şartlarda,

  • personal data are not processed unlawfully,
  • personal data are not unlawfully accessed and
  • preservation of personal data

undertakes to take the necessary technical and administrative measures to ensure the appropriate level of security and to carry out the necessary audits.

In the event that links are provided to other applications through the Site, the Company does not bear any responsibility for the privacy policies and contents of the applications.

Changes to the Privacy Policy

The Company may change the provisions of this Privacy Policy at any time. The current Privacy Policy becomes effective on the date it is published on DOMAIN.
